Is there anything I can do about a used car I bought 1 month ago that turned out to be junk?
cebdegaf@sbcglobal.net asked:
I bought a 2000 blazer for $4500 on March 15. It has 129,000 miles. In the past month I have been able to drive it about 7 times because its been in the shop so much. The transmission has been worked on twice and 2 mechanics said there is so much wrong that it should never have been sold. Now the abs just stopped working. What should I do? Im out of cash. Thanks for the advice.
this is in ohio and they said it has to be a new car

it is called the lemon law. they can sell u a used car, if the car has problems and they r aware of it and say a mechanic would say that the problem has been there and was not cause in the amount of time u had it, the have to give u ur money back. u will have to go through a lawyer and all that stuff. i bought a vette once and it was junk and that is what i had to do

In some states there are lemon laws for used cars, albeit not very good ones though. Even then there are certain requirements that must be met before any consideration is given. To the best of my knowledge Ohio doesn't have one but you should check with your states Attorney generals office if you haven't.
Unfortunately there's not much you can do, if you bought from a dealership or used car lot you can complain th them, write the BBB and hope something happens.
If you purchased from an individual then you are simply out of luck.
The issue with the abs is probably the abs module, which is usually somewhere around close to a grand to fix. If it's just the abs then the rest of your brakes should function normally, you just won't have abs. You should however have it inspected and diagnosed to ensure that it doesn't present any safety issues with the brakes and is OK to drive.
Sorry but there's not much positive advice to give, when buying a used car one should take the necessary steps to properly inspect and determine the quality of the car before buying. It's little help to you now I know and I'm not being critical but it happens all to frequently.
Buyers get stuck with lemons and there are few laws to protect them.
Sometimes even a thorough inspection will not necessary show all problems or be able to predict what may fail in the immediate future after buying.

There are two separate questions: do you have any legal rights? and if you do have rights, what as a practical matter can you do to vindicate them?
You definitely have rights. The main one that I would suggest you think about is your right not to be defrauded. This is a term that has a special meaning: did the seller make misrepresentations to you during the sale that the seller knew
to be untruthful? The fact that you are having problems with the vehicle is not enough. As you may know, the Blazer is a very problem-prone car, and bad ransmissions are high on the list of problems. Here is a site where other Blazer owners talk about the problems they encountered.
So the question is, did the seller say things that were obviously false, so false that no one will believe that the seller did not know what was going on? If so, then you get by the first question.
The second question is, what can you do about it? If the seller is a used car dealer, then I would suggest filing a complaint with the DMV dealer licensing board. This can be a very effective route. Car dealers, new and used, don't want to get on the bad side of the state.
Apart from that, or if the seller is a private party, then you should consider small claims court. Or if you have the sort of personality that can handle this, a very effective alternative is
to call, write, and bug the seller until they are in the position where they just want you to go away. If the seller is a dealer, get some friends and have a consumer picket in front of their business. There is no end to the lawful steps you can take to bring pressure to bear on someone who has done something improper.
Good luck. It will be a struggle, but a worthy one.
